Terms Of Service

Last Updated:

October 17, 2026

Effective upon publication for new purchases; see Section 26 for existing customers.

Please read these Terms of Service carefully before accessing our website, purchasing a product, registering for a program, or using our services.

IMPORTANT: SECTIONS 21 AND 22 CONTAIN WARRANTY DISCLAIMERS AND LIABILITY LIMITS. SECTION 23 CONTAINS A CLASS-ACTION WAIVER THAT APPLIES ONLY TO THE EXTENT PERMITTED BY LAW. THESE TERMS DO NOT REQUIRE ARBITRATION. PLEASE READ THESE SECTIONS CAREFULLY.

These Terms of Service (“Terms”) constitute an agreement between you and Andrew Mellen, Inc. (“Company,” “we,” “us,” or “our”).

By accepting these Terms at checkout or registration, or otherwise agreeing to them as permitted by applicable law, you agree to these Terms and any additional terms expressly disclosed for your particular purchase. Website use is subject to these Terms to the extent enforceable under applicable law.

Purchase-specific terms and written accommodations approved by the Company control over conflicting general provisions in these Terms for the matters they address. These Terms do not retroactively withdraw benefits or accommodations previously promised to a customer.

1. Company Information

ANDREW MELLEN, INC.
1444 S Belcher Rd
Ste C #2199
Clearwater, FL 33764
United States

Website: https://www.andrewmellen.com
Email: hello@andrewmellen.com

The Company provides educational programs, courses, workshops, coaching, memberships, digital content, books, physical merchandise, and related products and services.

2. Eligibility and Acceptance

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use our products and services.

By making a purchase, you represent that the information you provide is accurate, complete, and current and that you are authorized to use the selected payment method.

If you purchase on behalf of another person or organization, you represent that you have authority to do so.

If you do not agree to these Terms, you should not purchase or use our products or services.

3. Products, Programs, and Services

Our offerings may include:

Each product or program is governed by the benefits, access period, schedule, and conditions stated in its applicable offer and purchase terms.

Purchasing one program does not automatically include access to another program, future event, upgrade, or membership unless expressly stated in the applicable offer.

Programs may be offered in different versions, at different prices, and with different benefits over time.

A previous purchase does not automatically entitle the purchaser to features introduced in a later version.

4. Orders, Pricing, and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

We reserve the right to change prices, offers, bonuses, discounts, and program configurations at any time before accepting an order.

Promotional pricing applies only during the stated promotional period and is not guaranteed for future purchases.

Orders may be subject to applicable taxes, shipping charges, or other disclosed fees.

Payment must be completed through an accepted payment method.

We may use third-party payment processors to securely process transactions.

You authorize us and our payment processors to charge the payment method you provide for the amounts disclosed at checkout.

Payment plans, installment arrangements, and recurring charges, when offered, are governed by the specific terms disclosed at purchase.

Unless expressly stated otherwise, an installment plan is a method of paying the total purchase price, not a month-to-month membership that may be canceled without responsibility for the remaining balance.

For recurring subscriptions, renewal frequency, charges, cancellation procedures, and any applicable renewal terms will be disclosed before purchase. Recurring charges require the customer's affirmative consent. A fixed-term membership does not automatically renew unless automatic renewal was clearly disclosed and authorized. Customers may cancel renewal using the disclosed cancellation method or contact hello@andrewmellen.com for assistance. We will provide any notices and cancellation methods required by applicable law. Canceling future renewal is separate from requesting a refund for a current term.

We reserve the right to refuse or cancel orders involving suspected fraud, unauthorized transactions, pricing errors, product unavailability, or other legitimate business reasons, subject to applicable law.

5. Membership Terms and Start Dates

Some programs and memberships provide access for a defined period, such as 30 days, 90 days, 12 months, or another duration specified at purchase.

Unless otherwise expressly stated in the offer or confirmed by the Company in writing, a time-limited membership begins on the date of purchase and continues for the stated consecutive membership period.

Membership periods are based on elapsed calendar time, not the amount of content consumed, sessions attended, or benefits used.

A customer's decision not to participate, access materials, attend sessions, or use available benefits does not automatically pause, extend, renew, or restart the membership period.

Personal circumstances, scheduling conflicts, travel, illness, or other interruptions do not automatically change a membership's start or expiration date.

We understand that unexpected circumstances arise and may consider individual requests for assistance or accommodation.

However, any change to a membership's start date, duration, or expiration must be expressly approved by the Company in writing.

A membership does not remain unused or unactivated indefinitely simply because a customer has not participated.

Unless otherwise expressly stated in the applicable offer, unused time-limited benefits expire at the end of the membership period.

6. Deferrals, Postponements, and Extensions

We may, at our discretion, allow a customer to postpone participation in a particular program, cohort, event, or membership.

Deferrals and extensions are not automatic entitlements unless included in the applicable offer or previously approved by the Company in writing.

Requests should be submitted in writing to hello@andrewmellen.com as soon as the need becomes known, preferably before the scheduled start date.

A request is not approved merely because it has been submitted.

Any approved deferral must be confirmed by the Company in writing and will apply only to the specific program, benefit, dates, or period identified in that confirmation.

For clarity:

Where an accommodation is approved, the written confirmation will establish its scope.

A discretionary accommodation does not modify any other provision of these Terms unless expressly stated.

7. Live Programs, Cohorts, and Coaching

Live programs may operate on fixed schedules, recurring cycles, or other formats described in their offers.

Registration provides access to the specific live participation rights included in the purchase.

A purchase that includes a defined number of weeks or sessions does not automatically provide unlimited participation in future cohorts.

Similarly, a membership offering participation in multiple cohorts within a defined membership period does not create transferable credits that may be redeemed after that period unless expressly stated.

The applicable offer determines whether a cohort must begin or be completed within the membership period. We will honor any expressly promised number of complete cohorts; these general Terms do not reduce that commitment.

Live coaching may be provided as part of scheduled group sessions.

Group coaching does not include private or individual coaching appointments unless the specific offer expressly includes them.

Attendance at live sessions is the participant's responsibility.

We cannot guarantee that every participant question, chat message, or individual concern will be addressed during a live session.

Customer-service questions should be directed to hello@andrewmellen.com rather than submitted through live-session chat.

We may make reasonable adjustments to program schedules, delivery platforms, instructors, or presentation formats when necessary.

If a material change prevents us from delivering a purchased service, we will address the matter in accordance with the applicable program terms and law.

8. Digital Products, Recordings, and Lifetime Access

Digital products may include videos, recordings, downloadable workbooks, educational materials, and other online resources.

Access rights depend on the specific product purchased.

Some products include temporary access. Others include lifetime or Forever Access.

Where lifetime or Forever Access is expressly included, it provides ongoing personal access to the digital materials and recordings identified in the applicable offer, subject to lawful termination under these Terms. Expiration of a separate membership or live-participation benefit does not end those purchased access rights. Any duration or limitations expressly promised at purchase remain controlling.

Lifetime or Forever Access does not mean:

We may update, reorganize, replace, or migrate delivery platforms while preserving the substance of the access purchased. If we discontinue a delivery platform, we will provide reasonable advance notice and a replacement access method, such as another platform or downloadable copies where we have the necessary rights. If we cannot fulfill purchased access, we will provide an appropriate remedy consistent with the purchase agreement and applicable law.

We may also retire outdated platforms and provide replacement access locations.

Customers are responsible for using current access instructions supplied by the Company.

Digital materials are licensed for personal use and are not transferred into the purchaser's ownership.

Lifetime or Forever Access remains subject to lawful termination, refund, and intellectual property provisions in these Terms.

Nothing in this section limits any rights that cannot lawfully be excluded.

9. Upgrades, Bonuses, and Additional Benefits

Some purchases may include optional upgrades, order bumps, one-click offers, promotional bonuses, or additional membership benefits.

Each purchased upgrade provides only the benefits described in the applicable offer.

An upgrade may expand participation rights, access periods, or available programs without replacing the underlying purchase.

Unless expressly stated otherwise, the terms and expiration dates of an upgrade are independent of any lifetime access rights attached to the underlying product.

Complimentary bonuses are provided according to the conditions of the offer under which they were awarded.

A bonus offered with a paid-in-full purchase does not automatically become available to customers using other payment arrangements unless expressly stated.

Discounts on future events are not the same as complimentary admission to those events.

An offer providing complimentary Forever Access when purchasing an event does not mean that admission to the event itself is complimentary.

Customers are entitled to the benefits included in the version of the offer they purchased, not automatically to benefits offered in later versions.

10. Refunds and Cancellations

Refund eligibility depends on the nature of the product, the applicable offer, any specific refund policy disclosed at purchase, and applicable law.

Where a program has its own refund or cancellation policy, that policy forms part of the purchase agreement and controls the relevant purchase to the extent it does not conflict with mandatory law.

A request to cancel participation does not automatically establish eligibility for a refund.

Failure to attend, complete, or use a program does not by itself entitle a customer to a refund or extension.

We may, at our discretion, approve a refund, partial refund, credit, or other resolution outside the standard refund policy.

Such exceptions do not establish a general refund entitlement or precedent for future purchases.

Refund processing

Approved refunds will ordinarily be issued through the original payment processor to the original payment method.

Where permitted by applicable law and disclosed before purchase, a full refund means the purchase amount less any non-refundable transaction fees actually charged to the Company and retained by the payment processor for that transaction. We do not deduct processing fees that are returned to us. If a deduction applies, we will identify the fee and resulting refund amount. No deduction will be made where applicable law requires reimbursement of the entire purchase amount.

Customers cannot require a refund by paper check, bank transfer, cash, or a different payment card simply because they prefer that method.

If the original payment card has expired, been replaced, or been closed, the issuing financial institution generally determines how the refund is credited.

If a refund is rejected or cannot be completed through the original method, the Company may arrange an alternative lawful method after reviewing the transaction.

Where a refund has been approved, we will initiate reimbursement no later than 14 days after approval or receipt of qualifying returned goods, as applicable, unless a different period is required by law.

The time required for funds to appear in the customer's account may depend on the payment processor and financial institution.

We are not responsible for additional fees independently imposed by a customer's bank or payment provider, except where applicable law requires otherwise.

Effect of a refund

When a purchase is fully refunded, the associated program access, membership rights, bonuses, digital licenses, and other benefits provided exclusively through that purchase may be canceled.

A refund of one separately identified product or upgrade does not necessarily cancel other products in the same transaction.

We may refund individual line items where the purchase structure and circumstances permit.

Benefits independently purchased or earned through a retained purchase will ordinarily remain intact unless otherwise specified in a lawful resolution.

Customers who receive a full refund may no longer access, use, reproduce, or distribute the refunded product's proprietary materials, except where required by law or expressly authorized by the Company.

11. Physical Products, Shipping, and Returns

We sell physical products, including books, printed workbooks, and other merchandise.

Shipping charges, fulfillment methods, and estimated delivery periods may vary by product and destination.

Some physical products are printed, shipped, or fulfilled by third-party providers.

Estimated delivery dates may vary. For physical merchandise, we will comply with applicable shipment deadlines and, when required, notify customers of a delay, obtain consent to delayed shipment, or cancel and provide the required refund. Describing a date as an estimate does not waive these obligations.

Customers are responsible for providing accurate and complete shipping information.

If an order is delayed, lost, damaged, defective, or incorrectly fulfilled, customers should contact hello@andrewmellen.com with the order information and relevant details.

Returns

Physical-product returns are subject to the return policy disclosed at purchase and applicable law.

Where returns are accepted, items may be required to be returned in their original condition, with accompanying materials and packaging where reasonably applicable.

We may decline discretionary returns of damaged, materially used, personalized, or custom-made goods, subject to applicable consumer rights.

Customers should not return products without first contacting us for instructions.

Any customer-paid return shipping costs or restocking charges must have been disclosed before purchase and must comply with applicable law.

If a product arrives damaged, defective, or materially different from what was ordered, we will review the issue and provide an appropriate remedy as required by law.

12. Customer Conduct and Community Participation

We are committed to maintaining a respectful, constructive learning environment for customers, participants, instructors, and staff.

We welcome good-faith questions, criticism, complaints, and requests for clarification.

Disagreement with a business decision does not, by itself, constitute misconduct.

However, participation in our programs and communities requires respectful conduct.

The following conduct may result in moderation, restrictions, suspension, or termination of access:

Customers remain free to publish honest reviews and pursue legitimate consumer complaints, chargebacks, legal remedies, or regulatory inquiries. No provision of these Terms imposes a penalty for an honest review or requires a customer to transfer ownership of a review.

The Company will not treat the good-faith exercise of those rights as misconduct merely because a customer disagrees with a decision.

We may establish reasonable boundaries regarding communication frequency, methods, and support availability.

Where appropriate, we may require that customer-service matters be handled in writing.

We reserve the right to moderate or remove participants from private communities, live events, and other Company-managed spaces when reasonably necessary to protect the learning environment and our staff.

Any resulting cancellation or refund will be handled according to the applicable purchase terms and law.

13. Customer Support and Communications

Customer support is available through:

hello@andrewmellen.com

Support is provided during the Company's normal business operations.

Unless expressly offered, purchasing a program does not include 24-hour customer support, telephone assistance, or direct personal access to Andrew Mellen.

Customers should use the designated support email for account questions, billing matters, technical issues, and program access concerns.

Live-event chat, community discussions, and coaching sessions are not substitutes for customer-service channels.

We may send transactional emails, program reminders, access instructions, schedule updates, and other communications related to a customer's purchase.

Customers are responsible for providing a working email address and checking relevant inbox, spam, and promotional folders.

Failure to read or receive an email due to incorrect contact information, filtering, or individual email settings does not automatically extend a program or membership.

We will make reasonable efforts to assist with verified delivery or access problems.

14. Technology and Third-Party Platforms

Our programs may use third-party services for video meetings, course delivery, community participation, payment processing, email communications, or other functions.

Examples may include video-conferencing platforms, learning platforms, payment processors, and online community services.

Customers are responsible for having suitable internet access, compatible devices, and the basic technical ability necessary to use the purchased service.

We do not guarantee uninterrupted operation of third-party platforms or individual customer devices.

Technical difficulties affecting a customer's equipment, internet connection, browser, or email service do not automatically entitle the customer to refunds or extensions.

If a Company-controlled technical problem materially prevents access to a purchased program, we will review the issue and provide an appropriate remedy consistent with the applicable terms and law.

Third-party platforms may have their own terms and privacy policies.

15. Educational and Coaching Disclaimer

Our programs provide educational information, organizational strategies, coaching, and personal development resources.

We do not guarantee specific outcomes, financial improvements, emotional changes, productivity gains, or organizational results.

Individual outcomes depend on many factors, including participation, implementation, circumstances, and personal choices.

Our services are not a substitute for licensed medical, psychological, psychiatric, legal, financial, or other regulated professional advice.

Participation does not establish a therapist-patient, attorney-client, or other regulated professional relationship.

Customers should consult qualified professionals when appropriate for their individual circumstances.

We do not provide emergency mental health or crisis services.

16. Intellectual Property and Permitted Use

Unless otherwise stated, the Company's websites, courses, videos, recordings, books, workbooks, trademarks, methods, written materials, designs, and other original content are owned by or licensed to Andrew Mellen, Inc.

These materials are protected by applicable intellectual property laws.

A purchase grants the customer a limited, personal, non-exclusive, non-transferable license to access and use the purchased materials according to the applicable offer and these Terms.

Customers may not, without written authorization:

All rights not expressly granted are reserved.

17. Participant Content, Privacy, and Recordings

Participants may voluntarily share questions, comments, experiences, images, or other materials during programs or within private communities.

Participants are responsible for the content they share and should avoid disclosing information they do not wish others in the relevant setting to receive.

Live sessions may be recorded when disclosed as part of the program experience.

Recorded sessions may be made available to authorized participants according to the relevant program's access terms.

Participants should understand that their names, voices, chat contributions, or other participation may appear in recordings, depending on the event format.

We will handle personal information according to our Privacy Policy and applicable law.

Permission to use submissions; confidentiality requests

Subject to applicable law, when you validly accept this provision, you grant Andrew Mellen, Inc. a non-exclusive, royalty-free permission to reproduce, quote, display, and use comments, chat messages, feedback, testimonials, photographs, and other content you subsequently provide voluntarily in our educational and promotional materials, including our website, emails, social media, and advertisements, unless you request confidentiality or ask us not to use the content for those purposes. This permission may cover content submitted through programs, communities, email, direct messages, coaching, and customer support. You retain ownership of your contributions. We may edit excerpts for length or clarity without changing their meaning or presenting them misleadingly.

You may request confidentiality or exclusion from promotional use when submitting content or later by contacting hello@andrewmellen.com and identifying the material. We will exclude identified material from new promotional uses after receiving your request and take reasonable steps to remove it from promotional materials under our control. We cannot guarantee recovery of copies already distributed or independently shared by others. Any greater removal or consent-withdrawal rights provided by applicable law remain in effect. Requesting confidentiality or declining promotional use does not affect your purchased access or services.

This permission does not override an existing confidentiality agreement or authorize publication of payment details, passwords, contact information, or sensitive personal information merely because confidentiality was not requested. Use of a person's name, image, voice, recording, or other personal information remains subject to any additional consent required by law. Failure to request confidentiality is not a substitute for legally required consent, and acceptance of general Terms alone does not replace a separate consent where one is required.

This permission does not restrict honest reviews, require transfer of ownership of a consumer review, or grant rights to content you do not own or have authority to license. It does not retroactively authorize use of earlier submissions or private communications without an existing valid permission or other lawful basis.

Customers must respect the privacy of other participants and may not disclose private participant information obtained through our programs without appropriate permission.

18. Feedback and Suggestions

We welcome feedback, suggestions, and ideas regarding our products and services.

By voluntarily submitting non-confidential feedback, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and incorporate that feedback for lawful business purposes.

This provision does not transfer ownership of a customer's private personal information or override applicable privacy rights. It does not apply to public consumer reviews or authorize promotional use of a customer's identity or testimonial without any required permission.

19. Availability, Errors, and Changes to Offerings

We strive to provide accurate information about our products, schedules, prices, and services.

However, occasional errors, omissions, technical problems, or outdated information may occur.

We reserve the right to correct errors and update product descriptions, pricing, schedules, and availability.

We may modify or discontinue future offerings. Changes to future offerings do not, by themselves, remove benefits already purchased.

If a material error affects an accepted order, we will contact the customer with an explanation and an appropriate correction or cancellation and refund option. We will not charge an increased price for an accepted order without the customer's agreement.

If we cancel a paid program or cannot deliver a material purchased benefit, we will offer an appropriate remedy, which may include a comparable replacement accepted by the customer or a refund for the undelivered portion, subject to applicable law. Customers are not required to accept a credit in place of a legally required refund.

20. Suspension and Termination

We may suspend or terminate access for a material violation of these Terms, fraud, unauthorized sharing of materials or credentials, failure to make agreed payments, or conduct described in Section 12.

Where reasonably appropriate, we will explain the reason and allow an opportunity to correct the issue. Immediate restrictions may be imposed when necessary to protect participants, staff, intellectual property, accounts, or system security.

Restrictions will be reasonably related to the issue. Removal from a live event or community does not automatically cancel separately purchased digital access.

If the Company ends a paid service for business reasons unrelated to a customer's breach, we will address undelivered benefits under Section 19. If termination results from a customer's breach, refund eligibility and any remaining payment obligations will be determined under the applicable purchase terms and law; termination does not automatically make every payment forfeited.

Upon lawful termination of a digital license, the customer must stop accessing and using the affected licensed materials. Independently retained purchase rights remain subject to their own terms.

Provisions concerning accrued payment obligations, intellectual property, lawful limitations of liability, and dispute resolution survive termination to the extent applicable. Nothing in this section restricts the consumer rights described in Section 12.

21. Warranties and Disclaimers

Except for express commitments in the applicable offer or purchase agreement, and to the extent permitted by law, our website and services are provided on an “as is” and “as available” basis.

We do not promise uninterrupted or error-free website or platform operation, compatibility with every device, or a particular personal or business result.

To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement. These disclaimers do not override express purchase commitments, required remedies for undelivered or defective products or services, or warranties and consumer rights that cannot lawfully be excluded.

22. Limitation of Liability

To the maximum extent permitted by applicable law, the Company and its service providers will not be liable for indirect, incidental, special, or consequential losses arising from use of our website, products, or services, including lost profits or business opportunities.

To the maximum extent permitted by applicable law, the Company's total aggregate liability for claims arising from or relating to a paid product or service will not exceed $500. For claims arising solely from free website use, the total aggregate limit is $100. These limits are subject to the exceptions below. They do not cap court costs, dispute-resolution fees, or attorneys' fees that the Company must pay under applicable law or a separate written dispute-resolution agreement.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury or other liability that cannot lawfully be limited, or statutory remedies that cannot be waived. They do not reduce an expressly promised refund or excuse the Company from providing a remedy required by law.

Some jurisdictions do not permit particular exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted.

23. Governing Law, Resolving Disputes, and Class-Action Waiver

These Terms are governed by Florida law, without regard to conflict-of-laws rules, except where mandatory consumer protections or other applicable law require otherwise.

If a concern arises, please first contact hello@andrewmellen.com with your name, relevant order information, and a description of the issue so that we can attempt to resolve it directly.

Contacting us is encouraged but is not a prerequisite to filing a claim, seeking urgent relief, contacting a government agency, or exercising a lawful payment-dispute or other nonwaivable right. Informal discussions do not extend any legal or payment-dispute deadline unless a valid agreement or applicable law provides otherwise.

If the matter is not resolved, either party may bring a claim in a court with appropriate jurisdiction, including a small-claims court when the claim qualifies.

After a dispute arises, you and the Company may voluntarily agree in writing to mediation or arbitration. Neither party is required to agree. Any such agreement must identify the process, provider or neutral, allocation of fees and costs, and whether the result will be binding.

These Terms do not require arbitration or waive either party's right to a court or jury trial where otherwise available under applicable law, subject to the class-action waiver below.

Class-action waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ANDREW MELLEN, INC. AGREE THAT CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, OUR WEBSITE, OR OUR PRODUCTS OR SERVICES WILL BE BROUGHT ONLY IN EACH PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS ACTION. THIS WAIVER APPLIES TO COURT PROCEEDINGS AND DOES NOT REQUIRE ARBITRATION.

This waiver does not restrict any right or remedy that cannot lawfully be waived, including any nonwaivable right to seek public injunctive relief, or prevent complaints to or proceedings brought by government agencies. It does not prevent individual claims in small-claims court or another court with appropriate jurisdiction.

A court with appropriate jurisdiction will determine the enforceability and scope of this waiver. If the waiver is held unenforceable for a particular claim or jurisdiction, it will not apply to that extent, and the claim may proceed as permitted by law. The remaining provisions of these Terms will remain effective to the extent permitted by law.

This waiver applies only where validly accepted and does not retroactively change the terms of an existing purchase or dispute without a valid later agreement.

24. International Customers and Mandatory Consumer Rights

Our products and services may be available to customers outside the United States. Availability, delivery options, taxes, and charges may vary by location and will be disclosed as applicable.

Nothing in these Terms excludes mandatory rights available under the laws that apply to a customer's purchase, including applicable cancellation, withdrawal, refund, warranty, or consumer-protection rights.

Where immediate delivery of digital content or early performance of a service requires express consent or acknowledgment affecting a statutory withdrawal right, we will obtain that consent or acknowledgment separately as required. Accepting these general Terms alone does not waive a statutory withdrawal right where additional consent is necessary.

25. General Provisions

These Terms, the applicable purchase disclosures, and any Company-approved written agreement or accommodation form the agreement for the relevant purchase. Specific purchase terms or written accommodations control over conflicting general terms for the matters they address. Nothing here excludes legally binding representations or rights that applicable law preserves.

If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A failure to enforce a provision on one occasion does not waive the right to enforce it later. An individual accommodation does not create an entitlement to the same accommodation for other purchases or customers.

Customers may not transfer program access, memberships, or digital licenses without the Company's written approval, except where permitted by law or expressly allowed in the offer. This restriction does not limit lawful resale or transfer of an owned physical book.

If we transfer our business or obligations to a successor, that transfer will remain subject to purchased customer rights and applicable law.

Headings are provided for convenience. Any translation is provided for accessibility; the English version controls only to the extent permitted by applicable law.

26. Changes to These Terms

We may update these Terms and will identify the effective date of the published version. This October 17, 2026 revision takes effect for new purchases when published, not merely when drafted.

Existing purchases remain governed by the terms and commitments applicable when purchased, together with any valid later agreement or written accommodation. Posting revised Terms does not retroactively shorten a membership, revoke an approved deferral, remove promised access, or change the resolution of a prior transaction.

For material changes proposed for an ongoing customer relationship, we will make reasonable efforts to provide at least 30 days' advance notice and obtain additional agreement where required by law. Any longer legally required notice period applies. Changes required sooner by law may take effect as required, with appropriate notice.

Continued use will signify acceptance only where valid under applicable law. We will not rely on continued use alone where express consent is required.
